Abstract [ITA]: La Cassazione, Sezione IV, con la sentenza n. 37660, depositata il 14 ottobre 2024, è tornata ad occuparsi della sufficienza del narcotest per individuare la valenza drogante della sostanza stupefacente e, dunque, sulla offensività in concreto della condotta contestata. La Suprema Corte, nella sentenza in commento, fornisce utili linee guida al fine di stabilire quando è necessario procedere ad una perizia e quando è sufficiente il narcotest in atti.

 Abstract [ENG]: The Supreme Court, Section IV, with sentence n. 37660 of 14 October 2024, returned to deal with the sufficiency of the narcotest to identify the doping value of the narcotic substance and, therefore, on the concrete offensiveness of the contested conduct. The Supreme Court, in the ruling in question, provides useful guidelines to establish when it is necessary to proceed with an expert opinion and when the narcotic test in the documents is sufficient.
